The Advisory Trap
I remember how I was trained two decades ago. My supervisor taught me to be a neutral facilitator: “Here are the examiner’s objections and three possible claim amendments. How would you like to proceed?”
Today, that mindset is a recipe for disaster. If you only provide a menu of options, you are doing exactly what AI does best.
Map Makers and Mountain Guides
Think of AI as the ultimate Map Maker. It can process billions of data points to predict what a patent should look like, but it has no mind. It knows the trail maps, but it cannot feel the wind change.
To have the headspace to move beyond the Map Maker role, you must stop the manual labor. I built my Claim Drafter tool to handle the “data space”. It automates text production and enforces consistency, freeing you to lead the climb in the “consequence space”.
Becoming the Mountain Guide
Unlike an AI, the Mountain Guide doesn’t just display the map; they recommend the route. Becoming a Mountain Guide means mastering three things that no algorithm can touch:
- Situated Judgment: Integrating “weak signals” like a specific competitive landscape, an examiner culture, a litigation horizon, a client’s risk tolerance, budget constraints, and long-term commercial intent. This is context that AI cannot inhabit.
- The “Ghost” in the Patent: Providing the purposive human intention behind the text. This is the “Geist” that turns a linguistic draft into a strategic legal boundary.
- Accountability: AI cannot take responsibility for a strategic choice. The patent attorney is the one who stands behind the work when the plan is tested at the patent office and in court.
